LegCo to resume Second Reading debate for withdrawal of Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation (Amendment) Bill 2019 (with attachments)
The Legislative Council ("LegCo") will hold a meeting tomorrow (23 October) at 11:00 am in the Chamber of the LegCo Complex.
During the meeting, the Secretary for Security will resume the Second Reading debate on the Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation (Amendment) Bill 2019 for the purpose of making an announcement of the withdrawal of the Bill under Rule 64(2) of the Rules of Procedure. Under Rule 64(3) of the Rules of Procedure, the Secretary for Security may address the Council on matters relevant to the withdrawal of the Bill but no debate may arise on such an address.
The Second Reading debate on the Inland Revenue (Amendment) (Tax Concessions) Bill 2019, the Judicial Officers (Extension of Retirement Age) (Amendment) Bill 2019 and the Electoral Legislation (Miscellaneous Amendments) Bill 2019 will resume. If the Bills are supported by Members and receive their Second Reading, they will stand committed to the committee of the whole Council. After the committee of the whole Council has completed consideration of the Bills and their reports are adopted by the Council, the Bills will be set down for the Third Reading.
Meanwhile, the Mandatory Provident Fund Schemes (Amendment) Bill 2019, the Rating (Amendment) Bill 2019, and the Freight Containers (Safety) (Amendment) Bill 2019 will be introduced into the Council for the First Reading and the Second Reading. The Second Reading debate on the Bills will be adjourned.
On Members' Bill, the St. John's College (Amendment) Bill 2019 will be introduced into the Council for the First Reading and the Second Reading. The Second Reading debate on the Bill will be adjourned.
On Members' motions, Members will debate a motion under Article 73(9) of the Basic Law to form an independent investigation committee to investigate the charges against the Chief Executive for serious breach of law and/or dereliction of duty. The motion, jointly initiated by Hon Alvin YEUNG, Hon James TO, Hon LEUNG Yiu-chung, Prof Hon Joseph LEE, Hon Claudia MO, Hon WU Chi-wai, Hon Charles Peter MOK, Hon CHAN Chi-chuen, Hon Kenneth LEUNG, Dr Hon KWOK Ka-ki, Hon Dennis KWOK, Dr Hon Fernando CHEUNG, Dr Hon Helena WONG, Hon IP Kin-yuen, Hon Andrew WAN, Hon CHU Hoi-dick, Hon LAM Cheuk-ting, Hon SHIU Ka-chun, Hon Tanya CHAN, Hon HUI Chi-fung, Dr Hon CHENG Chung-tai, Hon KWONG Chun-yu, Hon Jeremy TAM, Hon Gary FAN and Hon AU Nok-hin (25 Members), is to be moved by Hon Alvin YEUNG. The motion is set out in Appendix 1.
Dr Hon KWOK Ka-ki will move a motion under Rule 49B(1A) of the Rules of Procedure to censure Dr Hon Junius HO. The motion is set out in Appendix 2.
Hon Dennis KWOK will move a motion under Article 73(5) and (10) of the Basic Law to summon persons concerned to produce papers and testify. The motion is set out in Appendix 3.
Dr Hon KWOK Ka-ki will also move a motion under Article 73(5) and (10) of the Basic Law to summon a person to produce papers and testify. The motion is set out in Appendix 4.
Hon AU Nok-hin will move a motion under the Legislative Council (Powers and Privileges) Ordinance to appoint a select committee to conduct an inquiry. The motion is set out in Appendix 5.
In addition, Hon Alvin YEUNG, Dr Hon KWOK Ka-ki and Dr Hon Fernando CHEUNG will move separate motions under Article 73(5) and (10) of the Basic Law to summon persons to produce papers and testify. The motions are set out in Appendices 6-8 respectively.
Hon Andrew WAN, Hon Jeremy TAM, Hon Claudia MO, Hon Tanya CHAN, Dr Hon KWOK Ka-ki, Hon LAM Cheuk-ting and Hon KWONG Chun-yu will move separate motions under the Legislative Council (Powers and Privileges) Ordinance to appoint select committees to conduct inquiries. The motions are set out in Appendices 9-17 respectively.
Meanwhile, Hon Dennis KWOK will move a motion on no confidence in the Fifth Term Government of the Hong Kong Special Administrative Region as set out in Appendix 18. Hon Claudia MO will move an amendment to Hon Dennis KWOK's motion.
Hon HO Kai-ming will move a motion on ensuring children's right to play for them to grow up happily. The motion is set out in Appendix 19. Hon IP Kin-yuen, Dr Hon KWOK Ka-ki, Dr Hon Fernando CHEUNG, Dr Hon CHIANG Lai-wan and Hon HUI Chi-fung will move separate amendments to Hon HO Kai-ming's motion.
On Government's motions, the Chief Secretary for Administration will move two proposed resolutions under Article 73(7) of the Basic Law and section 7A of the Hong Kong Court of Final Appeal Ordinance (Cap. 484) on appointment of judges. The two motions are set out in Appendices 20-21.
During the meeting, Hon Abraham SHEK and Hon Jeffrey LAM will address the Council on the Independent Commission Against Corruption ("ICAC") Hong Kong Special Administrative Region Annual Report 2018 and Reports of ICAC Advisory Committees, as well as the ICAC Complaints Committee Annual Report 2018 respectively.
Members will also ask the Government 22 questions on various policy areas, six of which require oral replies.
