Legal Service Division Further Report on Securities (Insider Dealing) (Amendment) Bill 1998

Members may recall that this Bill received its First Reading on 23 September 1998 and the Legal Service Division has made a report (LC Paper No. LS26/98-99) to the House Committee on 25 September 1998. We were instructed to follow up on Member's question relating to former Deputy Judges of the Court of First Instance.

2. We wrote to the Administration on 28 September 1998 and received its reply this morning.

3. The Administration confirmed that it is not its policy to include former deputy judges as potential candidates for the chair of the Insider Dealing Tribunal. As to former judges of the pre-unification High Court, the Administration is still seeking legal advice as to what should be done.

4. Subject to Members' views, the Bill is ready for resumption of Second Reading debate.
